speed bump damage

I would say that as you came to a stop you had plenty of opportunity to appraise the situation before riding over it. I think it's unreasonable to try to lay blame on the owner of the facility; it's pretty obvious it's there. I often bumped my Rocket over bigger obstacles and down gutters but never at 90 degrees and I never had a problem. It's easy, even in the photos, to see that the speed bump with that iron on top would be a problem straight on for something with the ground clearance and wheel base of an R3T. Just my opinion. Generally speaking, and I know this will upset some, I believe that people really do need to take responsibility for their actions. You saw the bump and decided to ride over it. Not unlike the truck drivers who get caught up under low bridges……….

Now if the speed bump was in a place where you'd be travelling at speed, and was unmarked with no hi vis paint etc, you might have a case.

As I said before speed bumps are not so bad if you cross them at an angle, everyone (I guess) has seen a low slung sports or modified car negotiation speed bumps and traffic calming devices they invariably slowly cross them at an angle ensuring the front wheels are on the bump longer to allow the under carriage to be raised as it passes over the bump , I do the same thing on my R3T
 
I thought about that but being a small claims case I would be surprised if they would even talk to me, but I might give it a try.
Every municipality up here has specific guidelines on speed bump construction, maybe dig deeper , call the city and look into it. If it is larger than their standard requirements, it's on them.
 
Check to see what your deductible is on your insurance policy under your collision coverage - Any time a part of your vehicle makes contact with another vehicle or object it is considered a collision, that is your case - hopefully your deductible is less than the repair cost!
Also your Insurance company can "subrogate" the claim amount back from the property owner of the speed bump & if they succeed they will also recover the deductible amount back to you ;)
 
from the look of that bump i would drop the bike over if i had to cross over at an angle. i would remove your tools before doing anything.
i think that small claims court might have a limit. it may be about $500 in az.
i would tell them it may cause the bike to fall over. that might help the next guy.
i would hand them the bill before i filled a claim. they may decide to pay instead of going to court.

When driving/riding on a public thoroughfare there is a reasonable expectation that they are designed safely.
From what I see I would contend this is an obstruction built as part of a gate and not a speed bump.
What about a motor proceeding on a 35 mph roadway in the dark and an unseen pot hole dumps the rider?
Is it the rider's duty to somehow anticipate the hole or perhaps ride at 10mph, risking a rear end impact?
Drivers/riders are NOT engineers, that's why there are building codes.
Just sayin' . . .
 
Thanks for your responses guys. I'll start looking into building codes for this area. It's because of those building codes that I had a reasonable expectation that the bump wasn't high enough to damage my stock height bike. For now I'm going to concentrate on getting it fixed

Hey Warp, I spotted that one last night and was thinking about it. My only concern with a used part is the possibility of being warped and difficulty getting to seal up. Are these plates hearty enough so that is unlikely? Also the dealer says i need all 21 new bolts as they are one time use only. I checked the manual and the only bolts I must replace are the pickup bolts if I remove the pickups. And do you recommend any kind of liquid sealer in addition to the gasket or just put the gasket on dry.
