Just got a ticket today in the mail from TX DPS. The cited me for driving at an "Unsafe Speed"

WTF? 10 mph under the limit in that curve is unsafe? How did they figure that?

Did you tell them you were speeding????
I was doing the speed limit and i had to wait on you for 10 minutes!!!

Thats bull$hit...no cops around...how the f#ck do they know you were speeding. F#ck em...contest it

There are witnesses that you were not speeding. Have those that were with you send you a email stating that fact or a hand written statement mailed the old way.

Hell, you could have them state the fact that the road repair was poorly done and that is the only reason you went down.

TexCav,
Some coppers would rather issue an infraction than take the time to justify to their supervisor in their report why one wasnot deserved.
There is no way anyone not a witness to the crash can know what your speed was. Unless the copper was a Superior Court qualified collision reconstruction expert AND he was able to obtain evidence supported by scene measurements, photographs and appropriate calculations, speed cannot be proven on a more probable than not basis.

Write a nice letter explaining you were NOT exceeding the speed limit and it was dirt or sand on the road surface that caused you to lose control.
State that you respectfully wish to contest the infraction and wish the attendance of the issuing officer should there be a hearing.
Further request ALL reports, statements and evidence that are being used in support of this charge be provided to you ASAP so that you may adequately prepare your defense.

Send this letter to the court address listed on the infraction. Also send a copy to the appropriate prosecuting attorney and one to the chief of police (or sheriff).

Dollar to a doughnut the charge is dismissed without having to go to court.
Good Luck,
