Not sure if this is prudent or not but I fill up from the right side of the bike. Never an issue. I wonder if the angle of the nozzle is somehow the issue. My two cents...

I've had nonproblem with my 2 week old brand new 3R. I stand on the right side of the bike since it's easier and put the nozzle rigjt down on the metal. Then when I start hearing the almost full gurgling I stop since I don't trust the auto shut off to work with me pulling the foreskin of the nozzle back. (That's a California thing)
My tank shows full after that.
I am finding the refueling a bit annoying especially with the metal internal ring thing. My 955i doesn't have this "fixture" I am sure it serves a purpose but I don't know what that might be? To insert the pump nozzle? Anyway, I fill up about 3 gallons, or so and then top off the rest from jerrican and funnel when I get back home. No spills, perfectly filled everytime.
This is a thread just made for the in-house comedians..
The insert is a gusset that I believe also serves to prevent you filling with diesel by mistake. I haven't tried it but I suspect a diesel pump nozzle will not fit through the hole. Harleys have them too. I got used to it with the Harley I had before I came to the Rocket, though it took a bit of getting used to with a few splash-backs at first, and now I don't have any problems.
I fill up sat astride the bike. Put the pump nozzle just through the hole in the gusset (no jokes..) and fill with about half pressure.
