Has more to do with the dealer? How so?

I did call Triumph direct. They said to get it in the dealer, have dealer take it apart, then call them to go over what it looks like etc. then they can figure out what problem is. So, I called dealer. They said they would call Triumph and start a "case." After about a month dealer called me and said Triumph was not going to do anything for me because it was out of warranty. I then wrote to Triumph and said spline was wearing from day one which was within warranty, and there should be an implied warranty on the second shaft. They wrote back and did not address the issue of wearing from day one, they merely stated that I drove bike for eight years and warranty was well expired.

And- this is what got me- they said as to implied warranty, I drove bike for 8 years as a motorcycle, therefore, they had fulfilled all of their obligations under an implied warranty. Well, what did they think I was going to drive the bike as- a submarine?

Far as I'm concerned they were just stonewalling. I think they are aware of the issue and just want to avoid taking responsibility. I spoke with a lawyer and he said not worth going after them, legal costs would exceed cost of replacement. So, here I am. They win. I just hate to back off when I know I'm right.

Thank you. My wife is from Plymouth so we go there quite a bit. If I have to do business with a dealer, I'll give them a try. My wife grew up on Lothrop St, just north of downtown. Matter of fact she grew up in the same apartment where they found all those dead cats. (Not while she lived in it, of course!)
