Looking at the tunes I can find, 260kmh seems to be the max it's set at. the program goes to 299kmh. any reason why it's not opened up all the way?

I would send the question directly to the developer. He will be able to give you the best answer.
 
The software does higher, just haven't seen any rocket iii maps that are set higher than 260. Didn't know if it was a limitation of the bike's ecu or a combo of the gearing/rev limiter combo that would make it a moot point to set it any higher than 260.
 
I was thinking liability as they would be setting it above the tires speed rating. So they left it up to the operator
