Had the same issue. It's the 2nd gear fork being worn out or bent. I've been down this rabbit hole all the way to the bottom and back with a shattered 4th gear. Trust me when I say it's just a matter of time before it starts popping out and 2nd becomes unusable. I rode around for a good year with no 2nd gear till forth shattered.
You basically have only one option. Split the engine apart and remove the trans and have it sent to Robertsons. There are multiple issues that they fix including a bilit 4th gear. The quotes me about a grand if I sent it to them.
Very much recommended the Robertson rebuild. Mine is now very very nice. Did the tear down and rebuild myself. Kept the cost under $1K at the time. Not sure what Robinson charges now, but whatever it is, it’s well worth it.

well im about to find out, in a short bit here im going to take the trans out of the rocket. i do NOT have the $ this year for the carpenter kit build so its going to be fun doing this job twice, taking the engine apart, im going to try and do the trans work with the engine IN the bike so .... im limited on time and space, Parents are moving in with us and we are moving into a new home and i need the bike to at LEAST move on its own power!

If you have some neat way to turn the frame over with the engine in the frame, good on ya. Otherwise, take the time and remove the engine and flip it over on a homemade saddle/cradle. Once you get the two halves apart, the crankshaft and balance shaft can stay put and it goes back together so much easier.
