Are you sure? My understanding is the 131" crate motor meets EPA if used with HD ECU, etc., just like their different Stage kits do.
Very obviously I could be wrong, but I've read that last $15,000,000 made believers out of them to the point they're denying warranty work on bikes with nonapproved modifications.
You know how it goes with money? If you are used to buying high end stuff then a figure looks less imposing. The older Rockets were cheap IMHO so that is why the new ones are a bit of a sticker shock.
The ECU is going to do whatever they tell it to, but yeah, air cooling's going to be a big challenge for sure.
Hell, my 500 EXC is water cooled and still has issues meeting emissions and making power.
